By using our services, you confirm that the information you provide to us is accurate and that you have the authority to agree on behalf of any business or organization you represent.
3. Project Orders and Agreements
Before work begins, Casthavens may provide a project proposal, quotation, package description, statement of work, or other written confirmation describing the services to be provided and the applicable price.
A project becomes confirmed when:
- The client accepts the applicable proposal or order;
- Any required payment or deposit has been successfully processed; and
- Casthavens confirms that the project can begin.
Where a separate written agreement exists between Casthavens and the client, that agreement will govern in the event of a conflict with these Terms.
4. Pricing and Payment
Prices displayed on our website are subject to change without notice. The price applicable to a confirmed project will be the price agreed upon at the time of purchase or stated in the applicable proposal.
Payments may be processed through third-party payment providers.
You authorize Casthavens and its payment providers to charge the payment method you provide for the applicable fees.
You are responsible for providing accurate billing information and maintaining a valid payment method.
5. Client Responsibilities
To complete a project efficiently, clients may need to provide:
- Business information
- Branding materials
- Logos and visual assets
- Images and other media
- Product or service information
- Access credentials where necessary
- Feedback and approvals
- Any other materials reasonably required to complete the project
The client is responsible for ensuring that materials supplied to Casthavens do not infringe the rights of third parties.
Delays caused by missing information, delayed feedback, unavailable access, or other client-related circumstances may affect the estimated delivery date.
6. Revisions
Revision availability depends on the package or project agreement purchased.
Where a package includes unlimited revisions, “unlimited” means reasonable revisions relating to the agreed project scope. It does not include entirely new projects, substantial changes to the original scope, or services not included in the purchased package.
Additional work outside the agreed scope may require an additional fee.
7. Delivery
Estimated delivery times are based on the project beginning after the required information, materials, access, and approvals have been received.
Any delivery timeframe communicated by Casthavens is subject to reasonable delays caused by circumstances outside our control.
Where a specific delivery guarantee is included in a written agreement, that agreement will govern the applicable commitment.
8. Third-Party Platforms and Services
Casthavens may build websites using third-party platforms and services, including but not limited to Webflow, WordPress, Framer, Shopify, Wix, Squarespace, HubSpot, or custom technologies.
Third-party services may have their own terms, pricing, limitations, availability, and privacy policies.
Casthavens is not responsible for outages, policy changes, pricing changes, security incidents, or other failures caused by third-party services.
9. Intellectual Property
Unless otherwise agreed in writing, upon full payment for a completed project, the client receives ownership of the original project materials specifically created for the client and included within the agreed scope.
This does not automatically transfer ownership of:
- Third-party software
- Third-party fonts
- Stock images
- Licensed assets
- Open-source software
- Third-party templates
- Plugins
- Platform-specific technology
- Casthavens proprietary tools, systems, processes, or reusable components
Such materials remain subject to their respective licenses and terms.
Casthavens may retain the right to use general skills, techniques, know-how, and reusable non-confidential development components.
10. Client Content
The client retains ownership of content and materials supplied to Casthavens.
By providing such materials, the client grants Casthavens permission to use, reproduce, modify, and display them as reasonably necessary to provide the contracted services.
The client represents that it has the necessary rights and permissions to provide those materials.
11. Portfolio and Marketing
Unless the client requests otherwise in writing, Casthavens may display completed publicly available work in its portfolio, website, presentations, and marketing materials.
Casthavens will not intentionally disclose confidential information supplied by a client.
Clients may contact us to request that a particular project or confidential material not be publicly displayed.
12. Refunds and Cancellation
Refunds and cancellations are governed by the applicable refund and cancellation terms presented at the time of purchase or described in our Refund & Cancellation Policy.
Where a project has already commenced, any refund may be adjusted to account for services already performed, unless a specific written guarantee provides otherwise.
Nothing in these Terms limits any consumer rights that cannot legally be excluded.
13. Acceptable Use
You may not use our services to create, distribute, promote, or facilitate:
- Illegal goods or services
- Fraudulent activities
- Copyright or trademark infringement

Our services are provided using commercially reasonable care and skill.
However, Casthavens does not guarantee that a website will achieve a specific level of traffic, revenue, conversion rate, search ranking, advertising performance, or business result.
Any performance figures, case studies, testimonials, or conversion improvements displayed on our website are examples and should not be interpreted as guarantees of future results.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Casthavens will not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our website or services.
Our total liability relating to a particular project will not exceed the amount actually paid by the client to Casthavens for that project, except where a greater liability is required by applicable law.
